With the implementation of EU Directive 2019/1937, better known as the Whistleblower Directive, European member states are committed to protecting whistleblowers. The aim of this directive is to protect individuals who receive information about violations of criminal law, administrative law, and other federal and state laws, regulations, and rules, and who wish to report them.

Depending on the number of employees, companies are required to establish and operate secure channels for reporting misconduct to avoid substantial fines and reputational damage. With the expiration of the transition periods, this obligation has applied to all companies with more than 50 employees since December 2023.

The following minimum standards must be met:

  1. The confidentiality of the whistleblower’s identity must be ensured
  2. Ensuring the long-term availability of the report while taking confidentiality requirements into account
  3. Demonstration of the necessary professional competence and independence of the persons responsible for receiving and processing reports
  4. Provision of anonymous and personalized reporting channels for whistleblowers
  5. Conducting a personal meeting at the whistleblower’s request
  6. Acknowledgment of receipt of a report in compliance with statutory deadlines
  7. Legal review and assessment of reported violations
  8. Conducting, documenting, and initiating all investigations and corresponding follow-up measures
  9. If necessary, referring the matter to a competent authority or concluding the proceedings

WIRA AG, together with its partner law firms, supports you in implementing the directive in accordance with all minimum standards. In addition to providing various reporting channels, this includes, in particular, the timely and appropriate processing of all incoming reports while ensuring absolute confidentiality.

We would be happy to guide you through the process of creating your first transparent sustainability report and work with you to develop effective processes that ensure the efficient preparation of future reports as well.
